Whenever we buy an electronic item or any major appliance from the market, the first thing that comes to mind is its guarantee or warranty. We also ask the shopkeeper about it. The main purpose of inquiring about the guarantee or warranty is to avoid too much trouble if the product malfunctions. However, despite the guarantee, some consumers face considerable trouble because shopkeepers refuse to honor the claims.
Today, we are going to tell you about your rights and how you can file a complaint against the shopkeeper in such situations. Complaint Procedure
First, show your guarantee or warranty card to the shopkeeper. If the shopkeeper still refuses despite everything being in order, you can file a complaint with the Ministry of Consumer Affairs or the District Consumer Forum under the Consumer Protection Act, 2019 of India. These institutions are there to protect your rights.
Shopkeeper refused? Now do this:
You need to go to a lawyer and write your name, the shopkeeper's name, and address on a letter. Then, you need to write about your complaint. Along with this application, also submit your warranty or guarantee card. This process is completely free of charge.
File a complaint in this forum based on the price:
If the price of your goods is up to 5 lakh rupees, the complaint will be filed in the District Consumer Forum.
If the price is between 5 lakh and 20 lakh rupees, the complaint will be filed in the State Commission's Consumer Forum.
If the price of the goods is more than 20 lakh rupees, the complaint will be filed in the National Commission's Consumer Forum. According to the Consumer Forum Act, complaints are filed through e-filing, i.e., online. Consumers have the right to obtain all information about the product and service.
Why are warranties and guarantees important?
Nowadays, most goods come with a warranty or guarantee. However, this is mostly applicable to electronic goods. It provides security to the consumer regarding their purchase. Electronic goods are quite expensive, and people cannot afford to buy them repeatedly. For these reasons, companies provide warranties or guarantees on these products. This guarantee and warranty are valid only for a limited period. In a warranty, the defective item is repaired, while in a guarantee, if the product is defective, it is completely replaced, or the money is refunded.
