What is a PIL? How can a common citizen file? Understand PIL filing process

Often citizens complain to the government’s system. If the constitution gives some fundamental rights to every citizen, then some fundamental duties have also been determined. Every person should follow. By doing this, every person can make special contribution in improving their society and country. If you have a complaint with the administration or you want to make some changes in it, then you can use PIL (PIL) for this.

PIL is a legal measure, which allows the common citizen or an institution to file a petition in the court in the interest of the public. Keep in mind that you cannot use this facility for personal complaints. Only by filing it a person or institution who is not affected by the case.

PIL can be filed for these cases

You can file PILs for matters to corruption, pollution, social, fundamental rights violations and environment. This also requires necessary documents with evidence and facts. Before filing the petition, clear what is your problem and what you want to demand from the court. Write the whole matter correctly in the petition. If the matter is big, the court primarily hears it. Social workers, NGOs as well as any Indian citizen can avail convenience in this public interest.

How and where to file a public interest petition?

PIL can be filed in the High Court under Article 226 regarding cases to the state government, administration and police. You can help a lawyer or submit the High Court in the High Court Registry. The prescribed fees are also charged. The e-fitting portal for different states is also different.

A PIL petition can be filed through Advocate on-record in the Supreme Court under Article 32 on fundamental rights or on any national level issue. For this, online e-filing “Efling.Ecourts.gov.in” facility also provides SC. First the necessary information will have to be registered and registered. Log in by entering the user name and password. Then file a petition with necessary documents and evidence.
