
Kapil Sibal had questioned the investigation of the Internal Committee, keeping the side of Justice Verma. He had said that there is no provision to recommend impeachment against any judge of the High Court or Supreme Court on the basis of internal investigation. In this way, he questioned the decision of former Chief Justice Sanjeev Khanna under which he constituted a committee of three judges.
In the investigation of that committee, the role of Justice Verma in the cash scandal was found to be wrong. Based on this, the former Chief Justice had recommended the PM and the President that an impeachment should be conducted against Justice Verma. When Kapil Sibal raised questions on this, the bench gave a sharp answer. A bench of Justice Dipankar Dutta and Justice AG Christ said, 'The arrangement of in house investigations came in 1999. Action is taken on the basis of that itself. Chief Justice is not a post office. They also have some responsibility towards the country. If the Chief Justice had any such thing, from which it seems that there has been some disturbance, he can tell the President and the PM.
On this, Kapil Sibal said that if you have already maintained your mind, what to do. On this argument, the bench said that we will remain silent and you are allowed to give arguments. Only then will the verdict give. But it would not be right to do so. So we are speaking. Kapil Sibal said that the way in which impeachment is being brought against Justice Yashwant Verma, if he moves forward then the wrong example will be set. There cannot be action only on that report. The bench also responded to his argument and said that you should not bring the report in the middle. Your point is whether the committee was unconstitutional or not. You talk about it only.
Court kept the verdict safe on demanding the investigation panel illegal
Justice Dutta said that a judge can be removed by the central government. But there is no law for this. If he makes any such law, we will test it. Do not talk about the powers of the central government in this matter. Talk to the Supreme Court and the High Court.
