Accepted impeachment motion on Justice Yashwant Verma in Lok Sabha!

Under the rare and constitutionally important developments in the country’s judicial history, the Lok Sabha on Tuesday formally read the impeachment motion against Allahabad High Court Judge Justice Yashwant Verma. Along with this, the way for the removal of them from post has been cleared under Articles 124 (4), 217 and 218 of the Constitution.

Lok Sabha Speaker Om Birla said in the House that he received the proposal on 31 July 2025, which has a total of 146 Lok Sabha members and 63 Rajya Sabha members, including former Union Minister Ravi Shankar Prasad and Leader of Opposition.

The case is to the controversy that came up in March 2025, when bundles of burnt notes were recovered during the fire incident at his government residence in Delhi.

However, Justice Verma was not present at the house at that time, but a three -member internal judicial inquiry later concluded that he had ‘control’ on this cash. Based on this report, the Chief Justice of India recommended his dismissal.

While reading the proposal in Parliament, Speaker Om Birla also announced that a statutory committee has been formed to investigate the allegations under the Judge (Investigation) Act, 1968 and rules.

The committee consists of Supreme Court Justice Arvind Kumar, Chief Justice of Madras High Court Justice Maninder Mohan Srivastava and Senior Advocate VV Acharya of Karnataka High Court. The committee will submit its report soon, till then the proposal will remain pending.

Justice Verma challenged the investigation report in the Supreme Court, calling it a flaw and constitutional encroachment in the process, but the Supreme Court dismissed his petition last week.

Describing the investigation process as transparent and constitutional, the court criticized his attitude that he first participated in the investigation and later questioned his legitimacy.

If the committee finds the allegations correct, the impeachment motion will have to pass by a special majority in both houses of Parliament, that is, two-thirds of the votes present and voting members and the majority of the total members. Only then the proposal will be sent for approval of the President.

This is the third time in independent India when the process of impeachment has been started against a working judge.
