Constitutional Law: Laughter-bound conversation between CJI Gawai and Solicitor General in the President’s reference case

News India Live, Digital Desk: Constitutional Law: In the Supreme Court, an interesting moment came during the hearing of petitions and President’s reference case filed for cancellation of Article 370 to Jammu and Kashmir in the Supreme Court. During the hearing, India’s Chief Justice (CJI) Justice BR Gavai and Solicitor General (SG) Tushar Mehta saw a laugh, when both of them commented lightly on ‘Smiling’, all of them started when the Solicitor General Mehta was giving his arguments and repeatedly suggesting that the court could also suggested that the court could be suggested. To this, Justice Gawai made fun of Mehta’s comment and said, “What to do if God has given me a smile.” All the people present in the courtroom smiled on this reply of the CJI. This incident happened at a time when Mehta was arguing that Jammu and Kashmir with the Indian Union was not merged with any ‘condition’. He emphasized that no document proves that Jammu and Kashmir’s merger in India was conditional. Earlier, CJI Gawai had questioned that if Article 370 was really of temporary nature and a 1935 India Act was required for circumstances such as autonomy given to the provinces, then why was it not referenced to the 1935 Act. SG Mehta’s argument was directly responding to this point, reiterating that no party presented any evidence to prove that Jammu and Kashmir’s merger in India was subject to any condition.
