Court Decision on APSC Probationers
Guwahati, Aug 21: On Wednesday, the Gauhati High Court intervened by putting a hold on the discharge orders concerning probationers selected by the APSC, who are implicated in a cash-for-job scandal.
The petitioners' attorney, Arunabh Choudhury, contended that the discharge orders contradicted the directives issued by the court's division bench.
Previously, the division bench had instructed the State government to issue straightforward discharge orders.
The petitioners maintained that the discharge orders were punitive and carried a stigma, rather than being a simple discharge.
Additionally, it was brought to the court's attention that the probationers had fulfilled their two-year probation term, and there had been no orders to extend this period.
After determining that the division bench's instructions were not adhered to and that the officers had not been reinstated, Justice Soumitra Saikia of the single bench stayed the discharge orders and issued a notice to the government.
