Supreme Court Ruling on Misconduct Allegations
The Supreme Court has found no evidence to support allegations of misconduct against a member of the Arunachal Pradesh Public Service Commission (APPSC) in connection with an exam paper leak case. On Thursday, the court ordered the immediate reinstatement of the suspended member.
A bench comprising Justices J.K. Maheshwari and Arvind Kumar addressed the presidential reference under Article 317(1) of the Indian Constitution, which pertains to the removal and suspension of the chairperson or members of the public service commission. They concluded that no charges against member Mepung Tadar Bage could be substantiated.
The bench stated, "The allegations against the respondent do not fall under the category of 'misconduct'; they do not even reach the threshold of 'negligence,' which is considered less severe. This is not a case where the respondent failed to uphold the expected standards of conduct as a commission member, nor did their actions tarnish the reputation of the APPSC."
It further noted, "In light of the above, the inevitable conclusion regarding the allegations against the respondent is that they have not been proven. In accordance with Rule 5 of Order 43 of the Supreme Court Rules, 2013, and responding to the presidential reference under Article 317(1) of the Constitution of India, this report will be sent to the President with a recommendation that no act of 'misconduct' has been established by Mepung Tadar Bage, allowing for appropriate action to be taken."
