Such Muslim men cannot marry more than one, Kerala High Court’s big decision!

The Kerala High Court has given an important verdict in the case of more than one Muslim marriage. Citing the verses of the Quran, the court made it clear that more than one marriages are justified under Muslim personal law, but its conditions are strict. The court said that if a person is not able to maintain his second or third wife, he has no right to marry again.

What is the whole matter?

The second wife of a blind man from Malappuram challenged the family court’s decision in which his claim of maintenance was rejected. The person was accused that he earns around Rs 25,000 every month by begging outside the mosques. But the family court rejected his claim, saying that a beggar could not be forced to maintain maintenance.

The victim made serious allegations

In her petition, the victim said that her blind husband threatened to divorce her and was planning to marry a third marriage. He also accused of physical attack, but the court did not accept it. The court said that it is not possible to happen until the victim is ready for it. Along with this, the court justified the family court’s decision on the claim of maintenance. However, the court made it clear that if a person is unable to maintain his wives, he does not have the right to marry again.

Court gave strict instructions to the government

Justice PV Kunkrishnan instructed the Social Welfare Department in this matter to give counseling to this blind person of Palakkad through religious leaders and capable consultants to prevent him from having a third marriage. The court said that the petitioner himself married the person, while his first marriage was already going on. Such marriages are often due to lack of awareness about Muslim personal law.

The court emphasized that if a person is not able to bear the expenses of his wives, then such weddings cannot be recognized again and again. Also, it is the responsibility of the government to help such people who are forced to beg for livelihood. If such a person marries again and again, the government should intervene.
