Due to a clerical error, 26-year-old Sushant Bais, a resident of Shahdol, Madhya Pradesh, had to stay in jail for more than a year. He was arrested last year on September 4, 2024 and was released from jail on September 9 this year after the High Court ordered his release.

In fact, Shahdol District Collector Kedar Singh had issued an arrest order under the National Security Act (NSA), in which Sushant's name was written in place of the actual accused Neerajkant Dwivedi.

Later it was argued that this happened due to a clerical error. Taking this seriously, Madhya Pradesh High Court has issued a contempt notice to Shahdol Collector Kedar Singh. Along with this, instructions have been given to give compensation of Rs 2 lakh to the victim Sushant. The next hearing of the case will be on November 25.

The victim approached the High Court against the action

A petition was filed in the Jabalpur High Court on behalf of Sushant's father, farmer Hiramani Vaishya, against the action. The High Court's double bench comprising Justice Vivek Aggarwal and Justice Avnindra Kumar Singh termed the case as a violation of fundamental rights and also criticized the state government. Said that the government did not investigate the arrest order properly before approving it.

According to advocate Ravindra Gupta, the point of penalty will be clear after the order is uploaded. Media coverage in this case has been based on the open court proceedings. The fact is that till now the order of WP/14004/2025 has not been uploaded on the High Court website. Therefore, the exact status of the fine will become clear after the completion of this process.

Victim said - those responsible should also remain in jail

26-year-old victim Sushant Bais says that NSA action has been taken against him under the influence of sand contracting company Sahakar Global. The mental pain of being in jail for one year and four days cannot be compensated by a compensation of Rs 2 lakh, hence in this case the SP should also be punished along with the Collector. Sushant says that his father has fought the legal battle of the case with a lot of struggle.
