In India, employees receive certain benefits, including Provident Fund (PF) and gratuity. These benefits are designed to provide financial security and stability. However, there may be cases where employers fail to deposit PF or gratuity. If you find yourself in this situation, it's important to understand the steps you can take to effectively resolve this issue.

Private employees have PF deductions. This responsibility lies with the government organization EPFO. This organization maintains your PF and pension accounts. A portion of your salary is deposited into your PF account. Your company contributes a portion to your PF and a portion to the EPF. However, sometimes your employer, i.e., your company, does not deposit funds into your PF account. If your Employee Provident Fund (EPF) account statement shows no contributions for several months, you should immediately be alert. Your employer may not have made the required deposit.

What should you do if your company hasn't deposited your PF?
The Employee Provident Fund (EPF) is a retirement savings scheme for employees. Both employers and employees contribute a fixed percentage of their salaries to this fund. EPF comes under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952.

If your PF deposits are delayed, you can do the following:

Check the date of filing of the ECR related to HR/Accounts.
Check the date of the deposit in your passbook.
If there are repeated delays, file a written complaint.
You can file a complaint with the EPFO.

If an employee's EPF contribution has been deducted from their salary but the employer does not deposit it into their EPF account, they can contact the Employee Provident Fund Authority (EPFO) and inform them of this. The employee can file a complaint on the EPFO's Grievance Management System (EPFIGMS) portal or submit a written complaint to the PF authority.

To file a complaint on the EPFO's grievance website, the employee must provide proof that the EPF contribution has been deducted but not deposited into the EPF account. The employee can provide their salary slip and EPF statement to prove that the employer made the deduction but did not deposit it into the EPF account.

What to do if you don't receive your gratuity?
For gratuity-related issues, you can contact the Labor Commissioner or Assistant Labor Commissioner in your area. They have the authority to address complaints related to non-receipt of gratuity. You will have to submit a written complaint along with the necessary documents like your appointment letter, salary slip, and details of gratuity dues.
