Lucknow POCSO Court sentences culprit to rigorous imprisonment in child sexual abuse case

what is the matter

This case was pending as session trial number 212/2018 against the accused Seni alias Shriram (aged about 30 years), resident of village Harda Majra Akdariya, police station Itaunja, Lucknow. According to the prosecution, at around 3:30 am on January 14, 2018, the accused illegally entered the house of the victim’s father and molested the minor victim. If she protested, he threatened to kill the victim and her mother.

After this incident, charges were filed against the accused under sections 452 (house intrusion), 354 (molestation), 506 (criminal intimidation) and section 7/8 (sexual harassment) of the POCSO Act.

The Court found the statements of witnesses presented by the prosecution—particularly the victim and her mother—to be credible, as well as other documentary evidence and convicted the accused of the crime. The judge said that the evidence presented was sufficient to prove the involvement of the accused.

The court has ordered that all the fine amount recovered from the convict should be provided to the victim as rehabilitation assistance. Also, a copy of the decision was sent to the District Legal Services Authority, Lucknow and instructions were given to provide compensation to the victim as per the rules of the court.
Orders were also passed to send the accused to District Jail, Lucknow to serve his sentence.

Strong message for society

While giving the verdict, the court said that child sexual crimes cannot be tolerated under any circumstances. This order gives a clear message to the society that strict action by law is mandatory against crimes committed against children.
