On Tuesday, the Supreme Court Bar Association, along with the Union government, informed the Supreme Court that they would be presenting joint recommendations aimed at preventing incidents similar to the recent attack on former Chief Justice BR Gavai.
Advocate Vikas Singh, representing the Bar Association, mentioned that these guidelines would also address how the media reports such occurrences, during a session with Chief Justice Surya Kant and Justice Joymalya Bagchi.
On October 6, an advocate named Rakesh Kishore allegedly attempted to throw a shoe at Gavai, claiming he was provoked by the Chief Justice's comments regarding the restoration of a decapitated idol of the Hindu deity Vishnu, as well as a Supreme Court ruling that deemed punitive demolitions unconstitutional.
Despite the disruption, Gavai maintained his composure, directed the court to continue, and later referred to the incident as a “forgotten chapter.”
Following this, the Supreme Court Bar Association initiated a petition for criminal contempt proceedings against Kishore.
During a hearing on October 16, the court suggested it might be preferable to let the incident “die a natural death” rather than allow it to gain traction on social media.
On October 27, Justices Kant and Bagchi indicated they were not inclined to pursue contempt actions against Kishore, noting that Gavai had previously chosen not to take further action against him.
In the recent hearing, Singh informed the bench that the Bar Association had prepared a set of guidelines and intended to include the Union government as a party in the case.
“This way, it could be integrated into the IT Rules or the Supreme Court regulations,” Singh stated. “We hope your lordships will incorporate it in some manner, ensuring accountability for media houses and social media platforms to prevent the spread of such content.”
Solicitor General Tushar Mehta, representing the Union government, expressed agreement with this proposal.
Singh had previously mentioned that although Gavai initially opted not to press charges against Kishore, the advocate later gave media interviews boasting about his actions and threatening to repeat them.
“This entire situation is being glorified,” Singh remarked. “The court possesses adequate authority to prevent a recurrence.”
He further argued that Gavai's decision to pardon Kishore was personal and should not affect the institution's stance.
“People are making light of this,” he added. “If he shows no remorse, he should be jailed immediately.”
Singh also asserted that Kishore had become “emboldened” due to the Chief Justice's earlier leniency.
