New Delhi: The Supreme Court on Monday, January 5, 2026, rejected the bail pleas of Umar Khalid and Sharjeel Imam in the alleged “larger conspiracy” case to the 2020 Delhi riots. The court said that based on the material presented by the prosecution, the charges against the duo are prima facie confirmed and their role appears to be more serious than that of the other accused.
However, the other five accused involved in the same case, Gulfisha Fatima, Meeran Haider, Shadab Ahmed, Shifa Ur Rehman and Mohammad Salim Khan, have been granted bail by the Supreme Court with strict conditions.
The court clarified that the role of each accused has to be assessed independently and all the accused cannot be viewed from the same perspective.
The Supreme Court also said that in cases involving serious laws like the Unlawful Activities Prevention Act (UAPA), mere delay in trial cannot be considered an automatic basis for granting bail.
The judgment also mentioned that Umar Khalid and Sharjeel Imam can apply for bail again after the completion of one year period or after the statements of the protected witnesses are recorded.
