The Supreme Court has adjourned the hearing on a petition challenging a new law regulating school fees in the national capital.

The Supreme Court has adjourned the hearing on a petition challenging a new law regulating school fees in schools in the national capital, Delhi, until February 2. A bench of Justices P S Narasimha and Vijay Bishnoi adjourned the matter after Additional Solicitor General S V Raju, appearing for the Delhi government, submitted that a meeting had been held with senior officials and another meeting was required to resolve the issues.

The Supreme Court agreed to list the matter on February 2.  The Supreme Court is hearing petitions filed by an association of private unaided schools challenging the Act and the subsequent rules.

Court had questioned the timing of the law's implementation

Earlier, on January 19, the court had questioned the Delhi government on the timing of the implementation of the Delhi School Education (Transparency in Fee Determination and Regulation) Act, 2025, given that the academic year had already begun.

The Delhi government recently notified the Act, which details the permissible heads for fees, accounting methods, and restrictions on extra charges, and prohibits capitation fees and any collection exceeding the amount permitted under the law.

HC refused to stay notification directing the formation of fee regulation committees

On January 8, the High Court refused to stay the notification directing private schools in the national capital to form fee regulation committees but extended the deadline for forming such committees from January 10 to January 20. (PTI input)
