Many people think that if they don't have time to see a doctor, they can get medicine directly from a chemist. But this is wrong, and the pharmacist can also face penalties for this.
In today's times, the safety and proper distribution of medicines have become a very important issue. Selling medicines without a doctor's prescription is not only against the law, but it can also pose a serious threat to the health of patients. This is especially true for Schedule H and Schedule X drugs, which can only be sold on the basis of a doctor's advice and prescription.
Many people think that if they don't have time to see a doctor, they can get medicine directly from a chemist. But this is wrong, and the pharmacist can also face penalties for this. If you find that a chemist in your area is selling medicines without a prescription, you can file a complaint. So, let's find out how and where a complaint can be filed, what kind of information is needed, and what action can be taken after the complaint.
Where can you file a complaint against a pharmacist or chemist?
1. State Pharmacy Council - In India, there are different government institutions for filing complaints about professional misconduct by pharmacists. Every state has a State Pharmacy Council. This council hears complaints against any registered pharmacist and can penalize them if found guilty. Some states have their own rules for filing complaints, such as the Kerala State Pharmacy Council Rules, 2012, the Tamil Nadu Pharmacy Council Rules, 1953, and the Maharashtra State Pharmacy Council Rules, 1969. In the complaint, it is necessary to provide your name, address, and details of the incident.
2. Drugs Inspector/Local Drugs Control Department - If a chemist is selling medicines without a prescription, you can file a written complaint with your district's Drugs Control Department or Drugs Inspector. 3. CDSCO (Central Drugs Standard Control Organization) - You can also file a complaint online at cdsco.gov.in.
4. Police Station - In serious cases, a report can be filed at the nearest police station.
5. 104 Helpline - In many states, health-related complaints can also be registered through the 104 helpline.
What information is required in the complaint?
When you file a complaint against a chemist, your complaint should include the name and complete address of the pharmacy, the name of the medicine, and the bill (if available), the time and date of the incident, whether the medicine was sold without a prescription, and any other relevant details that can substantiate the complaint. Selling medicine without a prescription is a punishable offense under the law. The State Pharmacy Council summons the pharmacist for a hearing after receiving the complaint.
