In New Delhi, Rajesh Prajapati, the primary suspect in the tragic death of a biker, has been placed under police custody for one day following a court ruling on Sunday. The police had initially requested a three-day remand, but the court limited it to just one day.
Prajapati, a sub-contractor, was the first individual apprehended in connection with the incident.
The victim, 25-year-old Kamal Dhyani from Kailashpuri, Delhi, tragically lost his life after falling into an open pit belonging to the Delhi Jal Board (DJB) in Janakpuri while returning home from work late Thursday night.
An FIR filed earlier on Saturday revealed significant safety oversights at the construction site.
The FIR indicated that the pit, part of a DJB project, was left uncovered on a busy road without any warning signs, reflectors, barricades, or adequate lighting.
At approximately 8:03 a.m. on Friday, a PCR call was made to the Janakpuri police station by a woman reporting that a biker had fallen into a deep pit near B-3B Block, Andhra School, Janakpuri. Following this, DD No. 25A was registered, and ASI Sunil Kumar, along with CT Samarjeet, promptly arrived at the scene.
Upon arrival, officers discovered a man and his motorcycle, registration number DL9SCJ9478 (Apache 160), submerged in a pit that measured around 20 feet in length, 13 feet in width, and approximately 14 to 15 feet deep. Initial investigations revealed that the excavation was part of DJB's ongoing work.
With assistance from the fire brigade, the injured biker was extracted from the pit and transported to Deen Dayal Upadhyay (DDU) Hospital in a PCR vehicle, accompanied by HC Babulal. Despite efforts to locate witnesses at both the scene and the hospital, none were found. A crime scene team and forensic experts were called to document the site.
Later, police received information via DD No. 60A from DDU Hospital confirming that the unidentified man had been declared 'Brought Dead' by medical staff. The deceased was estimated to be around 26 years old, with medical reports indicating he was found unconscious near Joginder Singh Marg, close to District Park, and had sustained abrasions on his upper abdomen.
The FIR concluded that the incident was a direct result of the negligence of the Delhi Jal Board and its contractor, who failed to secure the excavated areas on the main road, neglected to implement necessary safety measures, and did not provide adequate warning signs or lighting.
The FIR further emphasized that the responsible parties were aware that leaving an open pit on a public road without safety precautions could result in fatalities, yet they did not take any preventive measures or deploy security personnel.
Based on the conditions at the site, medical evidence, and other relevant details, the police have initiated a case under Section 105 of the Bharatiya Nyaya Sanhita (BNS), and the investigation is ongoing.
