The country’s top court on Thursday reserved its decision on the petition of Congress leader Pawan Kheda. Kheda had approached the Supreme Court after his anticipatory bail plea was rejected by the Gauhati High Court on April 24. In fact, Pawan Kheda had alleged that the wife of Assam Chief Minister Himanta Biswa Sarma had multiple passports and undeclared assets abroad. After this a case was registered against him in Assam.
A bench of Justice JK Maheshwari and Justice AS Chandurkar heard the petition on Thursday and reserved its decision. Pawan Kheda argued in the apex court that if he does not get anticipatory bail in the case registered against him, then the entire purpose of pre-arrest bail would be defeated.
Senior lawyer Abhishek Singhvi presented Pawan Kheda’s side in the Supreme Court. Pawan Kheda told the Supreme Court through his lawyer that there is no need to arrest and humiliate him. Singhvi said that out of the total sections imposed against Pawan Kheda, some are bailable. In others his arrest is not required.
Solicitor General Tushar Mehta presented the side of Assam government. He opposed Pawan Kheda’s petition. Mehta said Pawan Kheda showed fake and tampered copies of the passport of the Chief Minister’s wife. He is absconding. Releasing the video and all the allegations that the Chief Minister’s wife has multiple citizenships are false.
What is the whole matter?
Pawan Khera, in a press conference, had accused Rinki Bhuyan, wife of Assam CM Himanta Biswa Sarma, of holding multiple passports and having undeclared assets abroad. Later, Rinki Bhuinya had filed a criminal case against Pawan Kheda and others at Guwahati Crime Branch police station under several sections of the Indian Justice Code.
Telangana High Court grants seven days transit anticipatory bail to Pawan Kheda. However, Assam Police moved the Supreme Court. Later, the Supreme Court gave an interim order to stop granting transit anticipatory bail and asked to approach the Gauhati High Court. On the other hand, Gauhati High Court refused to grant anticipatory bail.
