New Delhi: Congress leader Pawan Khera got a big relief from the Supreme Court on Friday. After this decision of the court, now Assam Police will not be able to arrest Pawan Khera. The Supreme Court has granted anticipatory bail to Pawan Khera. With this decision, Pawan Khera has got protection from arrest for the time being. This relief will continue till the next hearing of the case. It is noteworthy that the Supreme Court on Thursday had reserved its decision on the anticipatory bail plea of Congress leader Pawan Khera. Assam Police had registered a case of defamation and forgery against Pawan Kheda. This case was registered when the Congress leader had leveled allegations against the wife of Assam Chief Minister Himanta Biswa Sarma.

The bench of Justice JK Maheshwari and Justice AS Chandurkar gave this decision in the Supreme Court. While hearing the case on Thursday, this bench heard the arguments of both the parties and after this the bench reserved the decision. On Thursday, Abhishek Manu Singhvi had made strong arguments on behalf of Pawan Kheda. Abhishek Manu Singhvi, appearing for Pawan Khera, said that there is no need to arrest him.
Singhvi’s argument worked
Abhishek Manu Singhvi had said that the allegation against Pawan Kheda is of defaming the complainant. Whether the allegations are true or not will be decided in the trial, but there is no need for arrest in this case. He can be interrogated on defamation charges. There is no need for arrest.
However, Solicitor General Tushar Mehta, appearing in the court on behalf of the Assam government, opposed the anticipatory bail of Pawan Kheda. He argued that Pawan Kheda had used several forged documents including passport to make false claims. Therefore, his custody is necessary to find out which of his associates were involved in this work and whether any foreign elements are also involved in it.

Tushar Mehta had argued
Tushar Mehta said that Himanta Biswa Sarma’s wife was accused of having a passport of Antigua. Antigua is the country where fugitives go. All allegations made regarding citizenship are completely false. The copy of the passport is fake and has been made by tampering. The Solicitor General said that as an investigating agency it is important to know how he forged this document? If it is fake then who made it
In which case FIR was registered against Pawan Kheda
It is noteworthy that this case was registered against Pawan Kheda on charges of defamation, forgery and criminal conspiracy when he had recently claimed in a press conference that the wife of Chief Minister Himanta Biswa Sarma has several foreign passports and undeclared properties abroad. A complaint was lodged against Pawan Kheda in this case. Assam Police had gone to Kheda’s Delhi house on April 7, but he was not present there.
Pawan Kheda had also gone to Telangana High Court

Later Pawan Kheda approached the Telangana High Court for transit anticipatory bail. The Telangana High Court on April 10 gave him a week’s relief, but also directed him to approach the Assam court. On 15 April, the Supreme Court stayed the Telangana High Court’s 10 April order on an appeal by the Assam government.
How and when did Pawan Kheda come to the Supreme Court?
After this, on April 17, the Supreme Court refused to extend the period of transit bail. The court asked Pawan Kheda to file an application in the Gauhati High Court instead. Then Kheda filed an application in the Gauhati High Court. On April 24, the Gauhati High Court had rejected the anticipatory bail plea of Pawan Kheda. After this Kheda filed the present petition in the Supreme Court.
