New Delhi: The Lucknow Bench of the Allahabad High Court has sternly reprimanded the Uttar Pradesh government and also imposed a fine of Rs 10 lakh on it. The court declared the act of the state government of detaining a man in jail for 3 months, without stating the reasons for it, as unconstitutional. The order was issued by the Division Bench of Justice Abdul Moin and Justice Pramod Kumar Srivastava, who were hearing a habeas corpus petition.
The court also directed that the state government may recover this amount from the officials responsible for this illegal detention.
Court questions functioning of administration , conduct of officials in UPThe court observed that if such was the condition of such high-ranking officials – including the Additional Chief Secretary (Home) of UP, then at what levels other officials of the state would be functioning. The court noted that in the affidavit that has been filed in the matter, the Additional Chief Secretary (Home), did not even explain why the fine should not be imposed upon the state government.
Citing various Supreme Court judgments the High Court noted that providing the grounds for arresting any individual in writing is a constitutional obligation. Disregarding this constitutes a direct violation of a citizen’s fundamental rights.
Who is the victim in this case, who was wrongfully detained?The petitioner, Manoj Kumar was arrested on January 27,2026 in a case registered at the Asiwan Police Station in Unnao district. The court found that he was kept in jail for the next 3 months, following his arrest. But the police failed to file any charges and neither could they give any clear reasons for the detention of the man.
The court has ordered Manoj Kumar’s immediate release, in case he is not accused in any other case. They further said that the police must give in writing the reasons for any arrest. If the police force fails to give reasons for arrest and keep any person in detention for a long time, then this is unconstitutional, said the Bench.
