He says that we have not lost the elections, hence there is no question of resignation. We won the assembly elections morally. I will not go to Lok Bhavan and resign. Now the question arises that what will happen if the leader of the losing party does not resign?
Whatever Mamata Banerjee's claim, the rule says that if a Chief Minister does not tender his resignation to the Governor even after losing the election, then the situation depends on the Constitution and the majority in the Assembly. There is such a system in the country that merely losing the election is not a reason for leaving the post immediately, unless the majority of the government is lost. What will happen if Mamta does not resign?
Article 164 makes it clear that the Governor appoints the Chief Minister, if the Chief Minister has lost the election or his party has lost the majority in the House and still he is reluctant to resign, then the Governor has the full right to remove him from the post.
The Governor can dissolve the present government with immediate effect by issuing an official order.
- first option- Under constitutional conventions, if the Chief Minister does not resign, the Governor can call a special session of the Assembly, in which a no-confidence motion is brought to prove majority. Since the election results have made it clear that BJP has 207 seats and TMC has only 80, it will be impossible for Mamata Banerjee to prove her majority in the House. As soon as the no-confidence motion is passed, the Chief Minister has to leave his chair in any case.
- Second option- If the Chief Minister continues to hold office despite defeat and refuses to resign, it is considered a failure of the constitutional machinery. In such a critical situation, the Governor can send his report to the Central Government and recommend imposing President's rule under Article 356. Once President's rule is imposed, the entire command of the state comes directly into the hands of the Center and the Governor and the powers of the Chief Minister are reduced to zero.
