Texas Jury Sentences FedEx Driver to Death for Kidnapping and Murder of Young Girl

A jury in Texas has imposed a death sentence on Tanner Horner, a FedEx delivery driver, for the kidnapping and murder of seven-year-old Athena Strand in 2022. This verdict was reached after 19 days of emotional testimonies, concluding a case that garnered significant public attention. Horner, aged 34, admitted to capital murder at the beginning of his trial on April 7, which led to the penalty phase where jurors had to decide between life imprisonment without parole or the death penalty. After approximately two and a half hours of deliberation, the jury opted for the death penalty, a decision that will be automatically appealed to the Texas Court of Criminal Appeals.


During the trial, prosecutors presented compelling evidence, including a disturbing hour-long audio recording from Horner’s delivery van made during the crime. Testimonies also included details of Horner’s confession, the extensive search for Athena, and the discovery of her remains. Prosecutors stated that Horner abducted Athena while delivering packages to her home in Paradise, Texas, in November 2022, before ultimately killing her.


In his closing arguments, Wise County District Attorney James Stainton characterized the crime as one of the most heinous, asserting that it justified the death penalty. The prosecution suggested that Horner had fantasized about committing such acts, referencing evidence of his previous thoughts on the matter.


On the other hand, Horner’s defense team pleaded for his life, highlighting his difficult childhood, autism diagnosis, exposure to high levels of lead, and ongoing mental health issues. They contended that the prosecution failed to demonstrate that he would continue to be a threat while incarcerated. Nevertheless, the jury dismissed these arguments.


The courtroom was filled with emotion as the sentence was announced, with family members of Athena expressing their grief. Her uncle delivered a poignant statement directed at Horner, emphasizing the profound impact of the child’s tragic death. Following the sentencing, Horner is set to be moved to the Allan B. Polunsky Unit in West Livingston, Texas, where he will await a scheduled execution date.
