Supreme Court Questions Earlier Ruling Denying Bail to Umar Khalid in Delhi Riots Case

The Supreme Court has raised significant concerns regarding its previous decision to deny bail to former JNU student leader Umar Khalid in connection with the Delhi riots conspiracy case. The court noted that the principles established in prior rulings related to long-term imprisonment under the Unlawful Activities (Prevention) Act (UAPA) were not properly applied in this instance.

In a landmark ruling from 2021, the Supreme Court stated in the case of Union of India vs. K.A. Najeeb that violations of the right to a speedy trial could serve as grounds for granting bail in UAPA cases. However, the court clarified that this precedent was not applied when denying bail to Umar Khalid.
