PTC Web Desk: A local court in SAS Nagar has declared the arrest of Shiromani Akali Dal (SAD)-affiliated Mullapur Dakha constituency in-charge Jaskaranjit Singh illegal and ordered his immediate release.
The court, while issuing its directions, observed that it is legally mandatory for the police to inform an accused person about the grounds of arrest at the time of detention.
According to information available, defence counsel HS Dhanoa argued before the court that Jaskaranjit Singh was taken into custody by the Matour police from Ludhiana, but the police failed to inform him about the reasons and legal grounds for his arrest.
During the hearing of the petition filed in this regard, the court made strong observations against the police action and stated that irrespective of the seriousness of allegations, due legal procedure must be followed in every case.
The court further clarified that failure to communicate the grounds of arrest amounts to a violation of the constitutional rights of the accused. Acting on these observations, the court ordered the immediate release of Jaskaranjit Singh.
