Gauhati High Court Reserves Bail Decision for Key Accused in Zubeen Garg Case

Guwahati, May 18: The Gauhati High Court wrapped up the bail hearing for Shekharjyoti Goswami, a primary suspect in the case concerning the death of Assam’s beloved cultural figure, Zubeen Garg. The court has decided to reserve its ruling until May 28.


After the hearing, Special Public Prosecutor Pradipta Talukdar informed the media, stating, “The court has set May 28 for the judgment. We presented our arguments, and the defense also had their say.”


Talukdar noted that, aside from Shyamkanu Mahanta and Goswami, no other defendants have submitted bail requests thus far.


The session also concluded with discussions regarding the framing of charges against the seven individuals listed in the chargesheet submitted to the fast-track court.


The lower court is expected to announce its decision on May 26 regarding the acceptance of the charges against the accused.


“The prosecution highlighted the evidence and charges outlined in the chargesheet, which includes Section 103 related to murder, fraud, and other offenses,” Talukdar added.


He emphasized that May 26 is a pivotal date in the case. “If charges are confirmed, the case will advance to the evidence stage, and the court will determine if additional witnesses or testimonies are necessary,” he explained.


In the meantime, Apurba Sharma, general secretary of the Lawyers' Association in Guwahati, expressed concerns regarding the safety of the accused if bail is granted, pointing out that bail conditions typically mandate regular court appearances.


“Bail is contingent upon specific conditions, one of which is that the accused must appear in court as required. However, given the current situation in Assam, it raises the question of who among the seven accused can safely attend court?” Sharma remarked.


He expressed confidence that the court would consider the existing law and order situation when making decisions on the bail requests.


Previously, the Gauhati High Court had scheduled May 22 for the bail hearing of Shyamkanu Mahanta in connection with the same case.


This case revolves around the ongoing legal proceedings regarding the events that allegedly led to Zubeen Garg's death.


The chargesheet implicates seven individuals under various sections, including murder and fraud.
