Delhi High Court today ordered to issue fresh notices to Aam Aadmi Party (AAP) national convenor Arvind Kejriwal, senior leader Manish Sisodiya and former MLA Durgesh Pathak. This order was given during the hearing on the petition of CBI, in which the trial court has challenged the acquittal of the accused in the liquor policy case. In its petition, CBI has challenged the decision of the trial court, in which several accused to the excise policy case were discharged in February. The agency says that re-examination of the lower court’s decision is necessary. The court has fixed the next hearing of the case on May 25.

Justice Manoj Jain noted during the hearing that the three defendants Arvind Kejriwal, Manish Sisodia and Durgesh Pathak had not appeared in the court even today. The court was also told that the three defendants had not appeared in the court on previous dates also. In its petition, CBI has challenged the decision of the trial court, in which several accused to the excise policy case were discharged in February. The agency says that re-examination of the lower court’s decision is necessary.

AAP leaders were not appearing before Justice Swarn Kanta Sharma. On this, Justice Jain directed the CBI to inform the three leaders that the liquor policy case has now been transferred to them. The court said that if they want to appear now, they can appear in the court. The court said, “We understand that this case has been transferred. This case is already in the headlines in the newspapers, so we assume that they know that the case has been transferred. But still, we will send them a fresh notice. A delay of one or two days will not make any difference, and only when they come here, we will know whether they are satisfied with the present allocation or not. The best situation would be that everyone is present here and everyone has a say.” Be heard.”

Next hearing will be on 25th May

The court said that the defendants can file any reply before the next date of hearing. The court directed that notices should be served on the defendants for whom no lawyer is appearing. The next hearing of the case has been fixed for May 25. During the hearing, Solicitor General Tushar Mehta said that the notice on the CBI petition was issued on March 9 and has been served on all the parties. He told the court, “They are aware of this. Subsequently, several orders were passed. I am not going to go into the merits of the case right now. This is a case where the charge sheet was filed because of serious allegations. The defendants filed applications for discharge… At the time of framing of charges, all had prayed for discharge, there was no specific application. The order of discharge cannot stand the test of law.” Tushar Mehta argued that this case is to an alleged ‘scam’ in Delhi and a decision should be taken as soon as possible.

Meanwhile, senior advocate Shadan Farasat, appearing for one of the respondents, said that there are some applications pending against the admissibility of the CBI petition, which should be decided first. “My argument is that the lawyers who have filed the review petition are not Additional Public Prosecutors or other government lawyers. They are private lawyers. I will argue my application,” he told the court.
