A very strict and big legal update has come to light in the famous and high-profile Twisha Sharma death case of Bhopal, the capital of Madhya Pradesh. Samarth Singh, the husband of the deceased and the main accused, who was absconding from the police for the last several days, has finally surrendered before the strict clutches of the law in Jabalpur District Court. Immediately after surrendering in the court premises, the police force present there took Samarth Singh into their custody.
According to legal circles, just before this the anticipatory bail application filed by Samarth Singh’s lawyer in Jabalpur High Court was withdrawn. As soon as the petition was returned, it became completely clear that the accused had no other option but to surrender.
Tough legal tussle between lawyers: Bhopal vs Jabalpur
After this tough surrender, important and technical statements have come out from the lawyers of both the parties:
-
Defense Argument: Giving more information to the media, Saurabh Sundar, lawyer of accused Samarth Singh, clarified, “Samarth Singh has surrendered here respecting the legal processes. We are filing a formal application before the Chief Judicial Magistrate (CJM) in the court so that the upcoming court proceedings can be taken forward.”
-
Objection of the aggrieved party: On the other hand, senior lawyer Anurag Srivastava, representing the family of deceased Twisha Sharma, has raised strong legal questions on the jurisdiction of this surrender. He said, “The main trial court of this entire case is located in Bhopal and the Chief Investigating Officer (IO) investigating the case is also from Bhopal Police. In such a situation, legally and practically, Samarth Singh should have surrendered either in the concerned trial court of Bhopal or directly before the Bhopal investigating officer. Surrendering in Jabalpur can only be an attempt to prolong the process.”
