First, understand that a cheque "bounces" (or is dishonoured) when the bank refuses to process it for payment. The primary reason for this is insufficient funds in the account. In India, regulations regarding bounced cheques fall under Section 138 of the Negotiable Instruments Act, 1881. Under this law, issuing a cheque that subsequently bounces—whether intentionally or due to negligence—is considered a criminal offense.

Can it lead directly to imprisonment?
The law stipulates that upon conviction, the accused may face imprisonment for up to two years, a fine of up to twice the cheque's amount, or both.
However, imprisonment does not occur in every case. The court's primary objective is to ensure the rightful owner recovers their money.

What happens after a cheque bounces?
*   A legal notice is issued first.
*   Upon receiving the notice, the cheque issuer is given 15 days to repay the amount.
*   The matter proceeds to court only if payment is not made within this period.

When can the situation worsen?
If a person repeatedly issues cheques that bounce and deliberately fails to make the payment or respond to the legal notice, the court may take a strict stance, potentially leading to a jail sentence. However, in many instances, both parties reach a mutual settlement. The Supreme Court has also stated that imprisonment can be avoided if a settlement is reached.
