Supreme Court on Doctors: Supreme Court Two privates in Ghaziabad today to hospitalsslammed a four-year-old rape victim for refusing to admit her. Private hospitals refused to admit her and she was declared brought dead.

The Supreme Court has slammed private hospitals accused of failing to provide first aid to a four-year-old rape and murder victim in Ghaziabad. Chief Justice Suryakant came down heavily on doctors in private hospitals saying, “If you are not doing your duty, you have no right to put the title ‘doctor’ before your name.” If you had even a little sensitivity, you would have taken the girl to another hospital even though the facilities were not available.

What was the case?
On March 16, a man lured a four-year-old girl with chocolate and kidnapped her and raped her. The accused fled leaving the girl in a desperate state. The family found her covered in blood and unconscious. The family took her to two private hospitals for treatment, but she was not treated there. Eventually, they took her to a government hospital, where she was declared brought dead.

The Supreme Court said in April that the most important aspect of the incident was the insensitivity shown by the hospitals, the local police and the family’s refusal to file a case. When the case sparked outrage, the police registered an FIR on March 17 and the accused was arrested on March 18. Most importantly, the FIR did not include POCSO and Section 376.
