The Kerala Waqf Board has moved the Supreme Court against the Kerala High Court order restraining it from taking any major decisions till the issues related to alleged violations in the constitution of the board under the Waqf (Amendment) Act are resolved.
A bench headed by Chief Justice of India Surya Kant and comprising Justices Joymalya Bagchi and V. Mohana has agreed to list the matter next Monday. Today, counsel for the petitioner State Waqf Board mentioned the plea and informed the court that the High Court order restraining it from taking any major decision has made it practically inactive.
What was the order of the High Court?
The Kerala High Court had issued an interim direction on July 15, restraining the State Waqf Board from taking any major policy decisions. The High Court had found that there were irregularities in its formation as per the Waqf (Amendment) Act.
The allegation is that the board has violated the requirement to include two non-Muslim members in its constitution. This direction of the High Court came on several PILs including the petition filed by BJP leader Shaun George.
Apart from other restrictions, the High Court had also directed the Board not to take any decision related to capital expenditure without the permission of the court.
The matter is listed for hearing in the Supreme Court on Monday.
