During the hearing of a case, the Court stated that a notice for income tax reassessment cannot be issued in the name of a deceased person.
What is the case about?
In this instance, the Income Tax Department sent a reassessment notice to an individual in March 2025, even though the person had already passed away in January 2024. The matter reportedly related to the purchase of a flat in Lucknow.
The Income Tax Department suspected that certain payments made during the flat purchase had not been accounted for. Later, upon learning of the individual's death, the department proceeded with tax proceedings against his wife. When the matter reached the Allahabad High Court, the Court delivered its verdict during the hearing.

The Court stated that if tax-related proceedings are to be initiated following a person's death, the notice must be issued in the name of the legal heir.
