The deadline for filing the Income Tax Return (ITR) is July 31. Many taxpayers believe that if they fail to file their ITR by the deadline, they will simply have to pay a late fee or penalty and the matter will be resolved. However, the reality is far more serious. Missing the July 31 deadline entails more than just paying a penalty; you may also face several other financial losses.
Let us understand in detail the potential losses associated with missing the deadline:
1. Immediate impact of late fees
Under Section 234F of the Income Tax Act, if you file a 'belated return' (i.e., after July 31), you are liable to pay a late fee of up to ₹5,000. However, if your total annual income is less than ₹5 lakh, the maximum penalty is capped at ₹1,000.
2. 1% interest on outstanding tax
If you have an outstanding tax liability and fail to file your ITR by July 31, you will be charged interest at the rate of 1% per month under Section 234A. This interest is calculated from August 1 until the day you actually file your ITR.
3. Inability to carry forward losses
This is a significant setback that stock market investors or business owners may face. If you do not file your return within the stipulated timeframe, you cannot carry forward losses incurred in the stock market (capital gains), business, or profession to the subsequent year.
4. Loss of interest on refunds
If excess TDS has been deducted and you are entitled to a refund, the Income Tax Department pays interest on that refund under Section 244A. However, if you delay filing your ITR, you will not receive interest for the period of the delay.
5. Losing the option to choose the old tax regime
Under the new rules, the New Tax Regime is now the default option. If you do not file your ITR by July 31 and wish to avail yourself of deductions such as 80C, 80D, or HRA available under the Old Tax Regime, you will not be able to opt for the old regime when filing a belated return.
The July 31 deadline is not just a date; it is an opportunity to save money. File your ITR immediately to avoid last-minute technical glitches and significant financial loss.
