Amidst the political turmoil and legal battle in West Bengal, the matter of freezing of bank accounts of All India Trinamool Congress (TMC) has reached the Supreme Court. While hearing this important case, the apex court has posed a sharp and practical question to the Enforcement Directorate (ED). The court has asked the investigating agency to consider whether the party can be allowed to withdraw a limited amount from the bank accounts to run its day-to-day affairs and expenses.

During the hearing of the case, a bench of Supreme Court judges examined the TMC’s financial situation. Lawyers representing the TMC informed the court that the party was facing a serious financial crisis due to the complete freezing of its bank accounts. Essential expenses for the party office, including employee salaries, and other administrative functions have come to a complete standstill. After hearing this argument, the court asked the Enforcement Directorate (ED) if the party could be granted some relief for routine expenses under the supervision of a special officer appointed by the Calcutta High Court.

What is the entire bank account freeze controversy and ED investigation?

This entire legal dispute is to an investigation being conducted by the Enforcement Directorate (ED) under the provisions of the Prevention of Money Laundering Act (PMLA). The central investigating agency froze the TMC’s bank accounts based on suspicion of suspicious financial transactions and financial irregularities. The ED claims that evidence of large-scale manipulation and financial transactions has been found in the accounts under investigation. The Trinamool Congress initially appealed this action to the Calcutta High Court, and after receiving no relief, the party has filed an appeal in the Supreme Court.

The hearing in this case isn’t limited to a financial fraud or investigation, but also concerns the democratic rights and smooth functioning of any political party. In its petition, the TMC argued that the complete closure of its accounts during this time of election and political activity is impacting its entire structure. This stance is expected to provide some relief to the party.
