US President Donald Trump’s new tariff policy has once again become embroiled in a legal dispute. Twenty-five Democratic-ruled states have filed suit against the Trump administration, challenging the new tariffs imposed on imports from 60 trading partner countries, including India.
The lawsuit was filed on Monday in the US Court of International Trade in New York, challenging the 10 to 12.5 percent import tariffs imposed last month under Section 301 of the Trade Act of 1974. The Trump administration argues that these tariffs are imposed on countries that are not taking adequate steps to prevent the export of products made with forced labor.
This case is being considered a new legal test of Trump’s tariff policies. Several of his tariff policies have previously been challenged in US courts. The lawsuit has been filed by 25 states, including Oregon and New York, all of which have Democratic Party governors or attorneys general. The states allege that the Trump administration is attempting to reimpose broad import tariffs previously declared illegal by the courts, but now, on different legal grounds.
The petition states that Section 301 was previously used only against countries or industries accused of unfair trade practices. It was not intended to impose broad tariffs on imports from virtually all countries. The states also allege that the forced labor issue is merely being used as a pretext to reimpose tariffs that had previously been repealed.
