HRA Rules: The Central Government has clarified that if one spouse receives government accommodation, the other employee will not be eligible for House Rent Allowance (HRA). Here are the full details regarding HRA rules.

Central Government Employees: If both spouses are employed by the Central Government, it is essential to be well-versed in the rules regarding House Rent Allowance (HRA). The government recently clarified in the Rajya Sabha that if a government-employed couple serving in the same location has one spouse allotted government accommodation, the other employee will not receive HRA. Since the family is considered to have housing facilities available in such cases, no additional rent allowance is granted.

Providing information on this matter in the Rajya Sabha, Minister of State for Finance Pankaj Chaudhary explained that HRA is intended solely for employees who have not been allotted government accommodation and who personally bear the cost of living in rented housing. Therefore, if one spouse already has access to government accommodation, the other does not receive the benefit of this allowance.

What is the government's rule?

According to the government, if both spouses are government employees serving in the same capacity, the family is treated as a single unit. Consequently, if one employee is allotted government accommodation, it is deemed that housing facilities have been provided to the entire family. In such a scenario, the other employee does not need to rent a separate home, as they do not incur additional housing expenses; thus, they do not receive the HRA benefit.

Will the rule change?

A question was also raised in the Rajya Sabha regarding whether the government was considering amending this rule to provide relief to both spouses. The government clearly stated that there are currently no plans to make any changes in this regard.

Employees living in rented accommodation.
Those who incur additional housing expenses.

Why doesn't the second employee receive HRA?

The government stated that HRA is provided solely to reimburse housing-related expenses. Consequently, if either the husband or the wife has already been allotted government accommodation, the other employee is not considered to be incurring separate rental expenses; therefore, HRA will not be granted to the second employee.
