Courier Company Refuses Liability for Damaged Parcel; Court Imposes Heavy Fine

Consumer Court News: The Consumer Court has ruled in favor of a customer regarding a courier company's negligence. A customer's sewing machine was broken due to the courier company's carelessness.

Legal News (Consumer Court): If you send important items via courier, take note. A man's sewing machine was ruined due to a courier company's negligence. The matter reached the Consumer Court, which ruled in the customer's favor and ordered the company to pay ₹50,000 in compensation.

This case involves a man from Kerala who had been working in Dubai for several years. Before returning to India, he sent four sewing machines home via courier. He dreamed of starting a tailoring business with these machines upon his return. However, when the parcel arrived at his home, he was shocked by the condition of the machines; they were severely damaged and rendered unusable.

The Matter Goes to Court

The customer immediately complained to the courier company and demanded compensation for the damage. However, the company refused to accept liability. Subsequently, the matter reached the Consumer Court, where arguments from both sides were heard.

During the hearing, an expert report was submitted. The report stated that the machines had sustained a severe impact during transport, causing extensive damage. It also revealed that the packaging did not meet international standards. The Court concluded that the goods had not been handled properly and that this constituted a deficiency in the courier company's service.

Although the customer could not produce the purchase bills for the machines—meaning the Court did not order reimbursement of the full cost—it acknowledged that the company's negligence caused him financial loss and mental distress, and prevented him from realizing his dream of starting a new business.

Court Imposes Fine on Company

On these grounds, the court ordered the courier company to pay the customer ₹50,000 in compensation and ₹10,000 towards litigation costs, along with 9% annual interest calculated from the date the complaint was filed until the payment is made. This verdict demonstrates that if a customer suffers a loss due to a company's negligence, they can secure both justice and compensation through the consumer court.
