Kejriwal reaches High Court against CBI's challenge in excise policy case, demands dismissal of petition

In the Delhi excise policy scam case, Aam Aadmi Party (AAP) national convenor and former Chief Minister Arvind Kejriwal has filed an application in the Delhi High Court opposing the review petition of the Central Bureau of Investigation (CBI). This case is to the order in which the lower court had acquitted Kejriwal, former Deputy Chief Minister Manish Sisodiya and other accused. Delhi's Rouse Avenue court had given relief to the accused in the excise policy case and acquitted them. The court passed the order after examining the available records, documents and material presented by the investigating agencies. The court believed that sufficient grounds could not be presented to frame charges.

The Central Bureau of Investigation (CBI) has approached the Delhi High Court against the lower court's decision to acquit Arvind Kejriwal, Manish Sisodia and other accused. The investigating agency has challenged the trial court's order by filing a revision petition. CBI says that the evidence available in the case and the facts revealed during the investigation were not given adequate consideration. According to the agency, some important aspects of the lower court order were not properly reviewed, hence judicial scrutiny of the decision is necessary.

Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia have raised questions on the validity of the CBI's review petition. Both the leaders, in their reply filed in the Delhi High Court, have said that the investigating agency has shown unusual haste in challenging the lower court's decision. The petition states that within just four hours of the trial court passing the acquittal order, the CBI filed a revision petition in the Delhi High Court. Kejriwal and Sisodia argue that it does not seem possible to study the detailed judicial order in such a short period and prepare a legal challenge against it, which raises questions on the attitude of the agency.

The two leaders, in their application filed in the High Court, have said that the CBI petition was filed in “extreme haste” and reflects the “non-serious attitude” of the agency. Kejriwal alleged that the CBI filed the review petition without adequate deliberations and proper study of the order. According to him, this shows that the agency decided to challenge the lower court's decision hastily instead of objectively evaluating it.

The petition also states that the case could not survive even at the initial stage of framing of charges. The court did not need to record statements of witnesses or proceed to a detailed hearing of the case, as the material available was not sufficient to establish prima facie charges. Both the leaders say that when the trial court has already examined the materials of the case and ordered acquittal, further hearing on the CBI's review petition would be an unnecessary waste of time of both the court and the parties. Kejriwal and Sisodia have urged the Delhi High Court to dismiss the CBI petition at the initial stage itself. Now the High Court can hear this matter next week, where the arguments of both the CBI and the accused will be considered.

23 accused including Kejriwal got relief

Delhi's Rouse Avenue court had earlier booked former Chief Minister Arvind Kejriwal, former Deputy Chief Minister Manish Sisodia, BRS leader K. All 23 accused including Kavita were discharged. The court gave this decision after examining the available records and investigation material. However, disagreeing with this order, the Central Bureau of Investigation (CBI) has challenged the decision of the lower court by filing a revision petition in the Delhi High Court. The investigating agency says that the trial court did not adequately consider many important aspects of the case and the available evidence.

Delhi government had implemented a new excise policy in the year 2021. Later there were allegations of alleged irregularities and favoritism in its implementation. After the controversy escalated, the Delhi government withdrew the policy. After this, the then Lieutenant Governor Vinay Kumar Saxena had directed CBI to investigate the case. The investigating agencies alleged that rules were violated during the formulation and implementation of the policy and undue benefits were given to some private entities.
