Kanpur. The court has termed the arrest of a textile businessman and his brother who gave a discount of only Rs 16 in Kanpur, Uttar Pradesh, as completely illegal. The Judicial Magistrate's Court has completely rejected the remand application of the police and has also issued orders for a departmental inquiry against the investigating officer who made the arbitrary arrest. The court has ordered the immediate release of both the accused on a personal bond of Rs 50,000.

Birthday '16 rupees offer' created stampede
Raees Alam, the operator of 'Alam Mart' located in Basmandi, Anwarganj, had posted an attractive advertisement on social media on the occasion of his birthday. Let us tell you that under this offer, clothes and other items were to be sold for just Rs 16 for just 16 minutes at midnight on 16th August. This reel went viral on the internet in no time. The result was that a crowd of more than 3,000 people gathered outside the shop at 11 pm on August 15 itself. When the shutter was pulled down when the crowd became uncontrolled, people started creating ruckus. To handle this serious situation, the police force of seven police stations had to resort to lathi charge, which led to a stampede on the spot and many people got serious injuries.
Court raised serious questions on police functioning
Let us tell you that after this incident, Anwarganj police had prepared to arrest Raees Alam and his brother Salman Alam and send them to jail on charges of disturbing peace and endangering public life. However, during the hearing, the defense lawyer argued in the court that the sections under which the police have registered the case have a provision for punishment of less than seven years. According to the guidelines of the Supreme Court, in such cases arrest cannot be made directly without giving notice. Accepting these arguments, the court considered the police action against the principles of law. Taking a tough stand, the court made it clear that the police had directly violated the legal procedure for arrest.
