Jasir Bilal Wani alias Danish, accused in the Red Fort terror case, got a big blow from the Delhi High Court on Tuesday, August 18. The court rejected his appeal challenging the trial court's decision refusing to grant him default bail.
Jasir Bilal had argued that the investigating agency did not complete the investigation nor file the charge sheet within the time limit prescribed in the law. On this basis he had demanded default bail.
NIA accused of involvement in conspiracy
Jasir Bilal Wani is a resident of Anantnag, Jammu and Kashmir. The National Investigation Agency (NIA) alleges that he was actively involved in the conspiracy to carry out the car bomb blast that took place in the Red Fort area on November 10, 2025.
Describing his role in the case as serious, the investigating agency has investigated terrorism- allegations against him. In the same case, Jasir had demanded default bail under the statutory right citing that the investigation was not completed within the stipulated period.
What is default bail?
Default bail is sought in a situation when the investigating agency is not able to complete the investigation and file the charge sheet within the period prescribed in the law. In such a situation, the accused may be entitled to bail under the law, provided the relevant legal conditions are fulfilled.
However, this argument of Jasir Bilal was not accepted by the Delhi High Court and refused to interfere in the order of the trial court.
What will happen next in the case?
After this decision of Delhi High Court, Jasir Bilal Wani will not get the benefit of default bail at present. The action of the investigating agency in the Red Fort blast case and the next legal process of the case will now be monitored.
