The Jharkhand High Court has stayed the state government's order cancelling 22 recruitment examinations and selection processes. The government had decided to cancel these exams via a notification issued on August 18.
Jharkhand Exam Controversy: The ongoing dispute regarding recruitment examinations in Jharkhand has taken a new turn. The High Court has stayed the state government's order cancelling 22 recruitment exams and selection processes. In its August 18 notification, the government had decided to cancel these exams, put six other exams on hold pending investigation, and subject 17 past recruitment drives to a CID probe.
This decision had created a crisis regarding employment for candidates who had already succeeded in these exams and been appointed to government service. Now, the High Court has stayed the government's decision. However, the government will have to present its side before the court during the subsequent hearings.
What was the entire matter?
The Jharkhand government had taken action regarding several recruitment exams conducted by the JPSC, JSSC, and associated agencies amidst investigations into irregularities and misconduct. This involved cancelling 22 recruitment exams, halting six others pending investigation, and ordering a CID probe into 17 past JPSC recruitment drives. The government's decision raised major concerns regarding candidates who had already secured appointments after passing the exams. Notably, four of the cancelled recruitment processes had reached the appointment stage. These included appointments for 342 posts via the 11th-13th Jharkhand Combined Civil Services Examination, 1,932 appointments via JSSC-CGL, 64 posts for Child Development Project Officers, and 56 posts for Food Safety Officers.
Crisis Faced by Selected Candidates
Following the cancellation of the exams, candidates already serving in government roles faced uncertainty regarding their future. Many candidates stated that they had passed the examination and secured appointments through the prescribed procedure, subsequently serving in government roles. Consequently, questioning their appointments without examining their individual conduct poses a significant problem for them. Some of these selected candidates reported receiving no information from the government regarding the future status of their appointments, prompting them to approach the High Court.
What arguments did the candidates present in the High Court?
The petitioners contend that the government cancelled the examination and the resulting appointments without hearing their side. They argue that if irregularities occurred during the exam, action should be taken against the specific guilty candidates or responsible individuals based on an investigation. The candidates question how the entire recruitment process could be scrapped—without individual scrutiny or evidence against specific candidates—thereby penalizing those who had cleared the exam and secured appointments through the standard procedure. They also submitted to the court that the principles of natural justice were not observed in their case. According to their counsel, the government must clarify the grounds on which the entire examination and the subsequent appointments were cancelled.
What happens next?
The most pressing question now concerns the ultimate fate of the cancelled examinations and the appointments made through them. Meanwhile, the High Court's stay order has provided immediate relief to candidates whose jobs or selection processes were jeopardized by the government's decision. Future developments are expected to hinge on the court's final order. The government has announced several measures to reform the recruitment process. A request will be made to establish a fast-track court for the speedy hearing of cases involving irregularities linked to the JPSC and JSSC. There is also a proposal to set up internal monitoring or vigilance cells within both commissions.
