New Delhi. The Supreme Court has issued notices to the MPs who left the party and joined NCPI after TMC's crushing defeat in the West Bengal Assembly Elections. Abhishek Banerjee had approached the Supreme Court demanding that the Speaker of the Lok Sabha take an early decision on the disqualification of 20 rebel MPs. The bench of CJI Surya Kant, Justice Joymalya Bagchi and Justice V Mohana has asked the rebel MPs to give their reply.

In another similar case in the Supreme Court, Abhishek Banerjee had demanded to issue notice to the office of the Lok Sabha Speaker and the Lok Sabha Secretary General. However the Supreme Court refused this. The court said that Solicitor General Tushar Mehta has appeared in the court on his behalf. Another similar case is being heard in the Supreme Court. Shiv Sena (UBT) had moved the Supreme Court after 6 of its MPs joined the Eknath Shinde-led Shiv Sena. The bench of Justices PA Narasimha and Alok Aradhe is hearing this petition.

Challenge to delay in disqualification proceedings: Banerjee in her petition has challenged the alleged delay in taking a decision on the disqualification proceedings initiated against the MPs. The Trinamool leader has requested directions to the Lok Sabha Speaker to take a decision on the disqualification petitions as per the anti-defection provisions of the Constitution. He had earlier filed separate petitions against 20 MPs and later requested the Lok Sabha Speaker to dispose of them quickly.
Banerjee had met the Lok Sabha Speaker. According to reports, Banerjee had also met Lok Sabha Speaker Om Birla on August 12 after being reminded in writing on this issue on July 27. This controversy has come to light after the rebellion in the parliamentary party of Trinamool. 20 Trinamool Lok Sabha MPs had announced that they have joined or merged with the Tripura-based political outfit Nationalist Citizens Party of India (NCPI). He had also requested for recognition as a separate party in the Lok Sabha.

Relying on anti-defection law, Trinamool says these MPs had won the election on the party's election symbol and their decision to join any other political organization is tantamount to voluntarily giving up the membership of the party. In such a situation, he can be disqualified under the anti-defection law.
