EMI is a facility by which if you do not have the full amount to buy any item, then you can buy a mobile or other items in installments by depositing some money as down payment. At the same time, many people are not able to pay the EMI of their mobile on time, due to which there is a fear in their mind that their smartphone might get locked or switched off. What is the new rule of RBI?

RBI’s new loan recovery rules are going to come into effect from January 1 next year. According to this rule, no bank or finance company can lock your phone immediately if you miss just one EMI. It will be mandatory for the company to give you written notice before taking any action against you. Apart from this, the technology that locks the phone must be certified by the mobile manufacturing company or operating system platform. RBI has made it clear that switching off the phone completely without informing the customer or suddenly will be considered illegal.

These features will remain active even if the phone is locked

  • Incoming calls on your phone will never stop.
  • Your phone’s message service (SMS service) will always be on.
  • The emergency SOS feature, which comes in handy in times of trouble, will always be active.
  • The company cannot impose any such restriction that your daily important work comes to a complete halt.

When can the company initiate action against you?

  • If your EMI is outstanding for more than 30 days, some minor restrictions may be imposed on your phone after giving you notice.
  • Only when the installment is pending for 60 days or more, the company can take the step of completely locking your phone.
  • The company will give you full time to deposit the money before taking any major action like locking the phone.
