From his safe haven in London, liquor baron and former Kingfisher Airlines chief Vijay Mallya has once again opened a front against Indian agencies and the government. Through a series of statements on social media platforms, Mallya has expressed strong objection to calling himself a ‘fugitive’. He clarified that they are not fleeing to return to India, but are unable to leave the country due to legal procedures and restrictions imposed by the UK judiciary. Mallya termed the Indian government’s action as ‘poster boy’ politics and alleged that a grave injustice has been done in his case by keeping impartiality at bay.
Vijay Mallya, citing an affidavit filed by the Enforcement Directorate (ED) in the Bombay High Court, claimed that banks and investigating agencies have recovered much more money than his dues. Based on the documents, he raised the question that when the original loan amount fixed by the court was approximately Rs 6,203 crore and the investigating agencies have already recovered or seized assets worth Rs 14,131.60 crore, why are they presented as financial criminals and fraudsters even today? Citing issues of accounting and financial justice, Mallya questioned why the media and the government do not discuss when the over recovered amount will be returned to him. He also reminded that it was from the attached assets that outstanding salaries of over Rs 350 crore were distributed to former Kingfisher employees.
On the other hand, the attitude of the Indian judiciary and investigative agencies remains very strict towards Mallya. During the hearing of Mallya’s petition against the Fugitive Economic Offenders Act (FEOA) in the Bombay High Court, the court had taken a strong stand and said that unless the petitioner appears before the jurisdiction of the Indian courts, he cannot get any kind of judicial relief. The Indian Ministry of External Affairs (MEA) has been continuously reiterating that talks are going on at the diplomatic and judicial level with the UK to bring back the economic offenders who have fled the country under the legal process. Even after the final approval of extradition in Britain, this process is getting prolonged due to some confidential legal and judicial complications, taking advantage of which Mallya is citing legal compulsion to come to India on technical grounds.
