4(2) of the Information Technology (Intermediary Guidelines and Digital Media Code of Ethics) Act challenged Meta. This section of the Act requires social media providers of messaging services to identify the originator of a message or the first sender of a message.
Advocate Tejas Karia appearing on behalf of WhatsApp before the bench of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora in the Delhi High Court said, “Common people use this platform for their privacy or privacy policy. WhatsApp messages have end-to-end encryption. We are saying as a platform, if we are asked to break encryption, WhatsApp will not exist.”
WhatsApp's lawyer said that this policy is against the privacy policy of customers or users. This rule was introduced without any discussion. India's Information Technology Act requires WhatsApp to collect or store billions of messages every year. Nowhere else in the world is this rule. He said, “We have to complete the chain of messaging. We never know when a message will be asked to decrypt. That means we have to store billions of messages over the years.”
WhatsApp also said that the original Information Technology Act did not mention breaking encryption. In South America, Brazil also has no such rule.
Incidentally, the Center had earlier told the court that Facebook, WhatsApp sell customer data for commercial purposes. Legally they have no right to claim that they protect customer privacy. Several countries have also called for Facebook to be held accountable.
The central argument for breaking encryption and finding the original source of messages was that many things can happen on social media. The main purpose of this law is to trace the original sender of the message.
