After hearing arguments from both parties, a three-judge panel led by Pakistan’s Supreme Court Chief Justice Yahya Afridi rendered the decision. Earlier in the day, Justice Hassan Azhar Rizvi took Justice Mian Gul Hassan Aurangzeb’s place on the bench.
Since the Supreme Court had previously granted bail in nine conspiracy instances that were identical, the Chief Justice questioned the prosecution on two important issues during the hearing: whether the bail case could be concluded and if the concept of consistency applied.
Resuming arguments after a day’s postponement, special prosecutor Zulfiqar Naqvi emphasized that bail rulings are usually temporary and have no bearing on the course of the trial. He gave a number of examples ranging from 1996 to 2024.
In spite of conspiracy accusations, the court pointed out that bail had been granted in other instances, such as the one involving PTI leader Ejaz Chaudhary. The prosecution was instructed by Chief Justice Afridi to describe the unique circumstances of Khan’s case.
Following a brief adjournment of the proceedings, the bench declared that Khan’s bail requests had been granted. A formal order will be issued later, the court stated.
The Supreme Court’s ruling provides relief to Imran Khan
Imran Khan, who is surrounded by political challenges, would greatly benefit from this court’s ruling. On May 9, 2023, Imran Khan’s fans staged a violent protest after his detention. Imran Khan was subsequently subjected to a number of cases.
Imran Khan is still dealing with a lot of other issues, however. The PTI founder, who has been imprisoned since August 2023 in connection with the government gifts case, is now serving a term in the £190 million corruption case at Adiala Jail. In a number of instances pertaining to the May 9 disturbances, he is also on trial.
