Bail Granted Amid Controversy

Ashish Kapoor, a television actor, has received bail from the Tis Hazari Court in Delhi concerning an alleged rape incident. He was taken into custody on September 3 after a woman accused him of sexual assault during a gathering at a private residence. The Additional Sessions Judge, Bhupinder Singh, approved his bail application, requiring Kapoor to submit a bail bond of ₹1 lakh along with a surety.

As reported by ETimes, Judge Singh stated, "Considering the observations and discussions presented, along with the evidence including CCTV footage, it is clear that the accused is no longer needed for the investigation. Given his status as a permanent resident of Delhi and his clean record, I find merit in the bail request, which is hereby granted."

The court determined that the reasons for police custody were inadequate, noting Kapoor's stable lifestyle, permanent residence, and business commitments, which indicated he would likely cooperate with law enforcement.

Highlighting flaws in the investigation, the court remarked, "Despite being placed on police custody remand, there were no genuine attempts to retrieve the mobile phone. Legal searches were not conducted, and there is no evidence suggesting the accused failed to assist in the investigation."

Kapoor's lawyer, Deepak Sharma, contended in court that the accusations were fabricated and aimed at extorting money from the actor.

Initially, the complainant alleged that multiple individuals were involved in the assault but later focused solely on Kapoor, claiming the incident occurred in a washroom at the party venue. She also alleged that the assault was recorded, although police have reported that no such footage has been found to date.

Additionally, the complainant accused a friend’s wife of physically assaulting her outside the washroom, prompting her to contact the police through a PCR call.
