According to court documents, the incident occurred on Super Bowl night in February while the pair were traveling on Interstate 95 in Flagler County, Florida. Mamby, 24, told Waterman she was pregnant, after which she received a message from a woman in New York. She became angry at this and the car crashed into a tree. Waterman suffered serious injuries and went into a coma.

According to an arrest affidavit obtained by People magazine, Waterman regained consciousness sometime in May. He tried his best to save his girlfriend and used a whiteboard to tell investigators that she was the cause of the accident. She told everything about the incident in the car, pregnancy, fights and speeding.
