Court Ruling on Personality Rights

Mumbai, March 10: The Bombay High Court has issued a ruling that safeguards the personality rights of Bollywood actress Shilpa Shetty from unauthorized use.


The court's decision prohibits defendants from misusing or misrepresenting her name, image, voice, likeness, or persona in any form.


Additionally, the court has mandated the immediate removal of defamatory and infringing content circulating on various platforms, emphasizing that a public figure's identity and reputation cannot be commercially exploited or digitally manipulated without their consent.


This ruling places the onus on digital platforms and intermediaries to promptly eliminate such unlawful content.


In response to this significant development, Supreme Court attorney Sana Raees Khan, representing Shilpa, praised the court's decisive action against deepfakes.


She stated, “The Bombay High Court has made it abundantly clear in Ms. Shilpa Shetty’s personality rights case that the internet cannot serve as a playground for deepfakes and digital impersonation. The court has upheld her personality rights and recognized that her name, image, voice, and persona are valuable legal rights that cannot be commercially exploited or digitally altered without her consent.”


The lawyer further added, “This order reinforces that digital platforms and intermediaries must act swiftly to remove such material and prevent the misuse of technology that infringes upon her dignity and reputation.”


Shilpa initially approached the Bombay High Court in November 2025 to seek protection for her personality rights.


Recently, the High Court raised questions regarding the legal status of various artificial intelligence tools that simulate celebrity personalities without consent.


It is important to note that Shilpa is not the first celebrity to seek legal protection against the misuse of their persona online.


Prior to the 'Dhadkan' actress, several Bollywood stars, including Kajol, Aishwarya Rai Bachchan, Shatrughan Sinha, Abhishek Bachchan, and Salman Khan, have also secured protection for their personality rights.
