Delhi High Court Issues Notice Against Summons to Bina Modi and Lalit Bhasin

The Delhi High Court has issued a notice regarding petitions filed by Bina Modi and Lalit Bhasin against summons issued to them. The court has also placed a stay on the ongoing proceedings in the lower court.


In February, the Saket court had summoned them in a case of assault filed by Sameer Modi. They have challenged this summons and are seeking its cancellation. Justice Saurabh Banerjee has requested a response from the Delhi police and has also issued a notice to Sameer Modi. Meanwhile, the proceedings in the lower court remain halted, with the next hearing scheduled for July.


Senior advocate Mukul Rohatgi represented Bina Modi, arguing that the summons order was unjust. Bina Modi, who was a witness, has been implicated as an accused by the court, making the summons order baseless.


Arguments Presented in Court

Senior advocate Rajiv Nair appeared on behalf of the petitioner, lawyer Lalit Bhasin. During the hearing, Mukul Rohatgi contended that no incident occurred during the board meeting in question, referencing CCTV footage from that day. He noted that Sameer Modi entered the meeting room at noon and remained there until 2 PM, signing approximately 20 pages during the meeting. He questioned how Sameer could have signed documents if his index finger was broken.


Justice Saurabh Banerjee reprimanded the investigating officer, inquiring how they concluded that Sameer Modi's finger was broken due to assault.


Further Court Inquiries

Justice Banerjee further questioned the investigating officer, asking, "He (Sameer Modi) was in the meeting for two hours; did he inform anyone about his injury?" On February 10, 2026, the Saket court had issued summons to Bina Modi and Lalit Bhasin in a case filed by their son, Sameer Modi. The Delhi police submitted a charge sheet stating that there was insufficient evidence to proceed against them. The court acknowledged the charge sheet and issued the summons. The Delhi police had implicated Bina Modi's PSO, Surendra Prasad, in the case, which relates to an FIR lodged by businessman Sameer Modi at the Sarita Vihar police station in 2024.
