8 MPs including Rajya Sabha MP Raghav Chadha have resigned from Aam Aadmi Party and 7 will join BJP.
Rajya Sabha MP Raghav Chadha has announced to break ties with Aam Aadmi Party (AAP). Raghav Chadha has said in the press conference, 'Two-thirds of the party's MPs are with us and we are merging with BJP. I am moving away from Aam Aadmi Party and among the public. At present AAP has 10 MPs in Rajya Sabha. Of these, 7 are from Punjab and 3 from Delhi.
Now the question is whether after the merger of two-thirds of the MPs including Raghav Chadha with BJP, will his Rajya Sabha membership remain or will he lose his chair? The answer to this question has been given in the anti-defection law.
What will the Rajya Sabha MP do?
Such cases have been mentioned in the anti-defection law. The law says that if an MLA or MP leaves the party, he can be disqualified. Even if he votes against the party, he can be disqualified. Not only this, if a member does not vote even after the whip is issued by the party, he can be brought under the ambit of this law, but this rule does not apply in the case of two-thirds of the MPs including Raghav Chadha.

Defection is also a way to escape the law. The law says that if one or two MPs or MLAs leave the party, action can be taken against them under the anti-defection law. But if two-thirds of the total MLAs or MPs of the party leave the political party, this law will not apply. That means action cannot be taken against them. In such a case, the membership of MLAs and MPs will remain intact.

In this way it has become clear that the MPs who leave AAP will not lose their MPs. During the press conference, Raghav Chadha has repeatedly stressed that two-thirds of AAP MPs are with him.
