New online gaming rules will come into effect from May 1. There will be a complete ban on games played by investing money. The government will promote e-sports and social gaming. 30% tax and TDS will have to be paid on the earnings from gaming.
Big changes are going to happen in the world of online gaming in the country. The new rules of the Central Government will come into effect from May 1. The biggest change is that online games played by investing money will be completely banned. However, the government will promote e-sports and social gaming and also give them legal protection. These rules are part of the 'Promotion and Regulation of Online Gaming Act', which was passed by Parliament in August 2025.
Gamers Know: What will change?
After the implementation of the new law, both gamers and companies will have to follow certain guidelines:
Ban on playing with money: Such online games in which money is invested will be banned in the entire country. However, non-paid social games and e-sports will continue.
Safety Rules: Gaming platforms will now have to set age limits, limit playing time and provide features like parental controls.
Grievance Redressal System: Every gaming platform will have to create its own grievance redressal cell.
What are the money games?
The new law clarifies some things to determine whether a game is for money or not:
If you have to pay any fee or deposit money to play.
If there is hope of getting money or any other valuable prize if you win.
If the things inside the game (virtual assets) can be converted into real money outside.
It will be necessary to clearly display the terms of service of such games to the customers.
Have a complaint? The solution will be like this
The government has created a three-level system to resolve gaming-related complaints:
First level: You can directly contact the complaint cell of the company providing the game.
Second level: If you are not happy with the company's response, you can appeal to the 'Online Gaming Authority of India' within 30 days. This authority will try to solve your problem in 30 days.
Third level: The final appeal can be made to the IT Secretary, who will be the final authority in this matter.
How much tax will have to be paid?
You will have to pay tax on the income earned from online games as per Income Tax law:
30% tax: Under Section 115BBJ of the Income Tax Act, 30% tax will be levied on the total income earned in a financial year.
TDS: Apart from this, under Section 194BA, TDS (Tax Deducted at Source) will also be deducted on the amount present in the user's gaming account.
alert: In tax related matters, take advice from an expert or visit the official website of the Income Tax Department.
